The present volume forms part of a series of Calendars of the Patent Rolls from the reign of Edward I. to that of Henry VII., the object and character of which are explained in the Preface to the first volume for the reign of Edward III. (ad. 1327-1330.) The text has been prepared, under my immediate supervision, by Mr. R. F. Isaacson, an Assistant Record Keeper, and he has also compiled the Index.

Westminster, dated at Westminster, 21 September, 21 Edward III, granting for life* to his yeoman, Roland Daneys, the bailiwick of the constableship of the castle of Cardigan, the keeping of the gaol of the same castle and the office of the stewardship of the county of Cardigan, with the four rhaglawries, to wit Caerwhetheres, Maubonyan, Croidyn and Comotpervyth, with all the profits, fees and advantages such as Sir Gilbert Turbelvile or any others have anciently taken or received on account of these offices, 10/. yearly for the constableship and the keeping of the gaol, and power to appoint lieutenants in the same offices without being interfered with on the part of the prince : and confirmation of the grant notwithstanding that the premises will revert to the king if the prince die in his lifetime.

Feb. 6. Whereas the king by writ of privy seal lately commanded the treasurer

Westminster, and barons of the exchequer to come to an account with Robert de Burghcher of all debts or receipts required of him by summons of the exchequer by way of loan or otherwise, making him due allowance according to the tenor of the king's letters patent and writs under the great seal made to him, and in case it should happen that by such account it should be found that he was not indebted to the king to cause general letters of acquittance to be made to him, and whereas it is now intimated to him on behalf of the said Robert that, although he has accounted in full up to the present date and by that account it is found that he is not in the king's debt but the king is indebted to him in large sums, as by an indorsement of the king's letters aforesaid would more fully appear, the treasurer and barons have not yet made him the king's letters of acquittance according to the tenor of the king's mandate, for which he prays redress ; the king by these presents acquits the said Robert of all manner of debts and receipts required of him by way of loan or otherwise to this date and likewise of the reward which he has now received for his progress on his service to the parts of Spain, provided that he be held only to give an account of that which he has now received for his wages for half a year in going to the said parts. void, as in his letters patent thereof is more fully contained ; the dean and chapter have now given the king to understand that some hindrances and impeachments have been made against them in the matter of the fruits in the lands of the see in the time of the last voidance, sown by them and their ministers, and the collection and taking of these, by colour of the restitution of the temporalities of that see to John, now bishop of the same place, praying that for redress herein and removal of such impeachments in future voidances, he will make an express declaration herein ; and he, after the whole matter had been expounded before him and the nobles and men skilled and learned in the law of his council in the present Parliament at Westminster, on more full con- sideration that the fruits in the said lands in time of voidance sown by him are and of right ought to be his chattels, that any chattels ought not to pass out of his hands by the general words of the restitution of temporalities and that the dean and chapter, as his farmers, by virtue of the grant of the custody aforesaid ought to have such fruits as fully as he would have them in like case, by counsel of the said nobles and men skilled in law, declares and by these presents makes known to all that as well the dean and chapter as any other having like estate in such temporalities and their successors shall collect any fruits sown by them or their ministers in lands and places pertainining to such temporalities while the same shall be in the king*s hands, and make their profit of the same without hindrance by the bishops or other presidents of the same places. Commission of oyer and terminer, dated 11 July, 20 Edward III, to the justices aforesaid touching the persons who killed William Sautcheverell at Derby. Pursuant to that commi sion the sheriff is charged to summon a jury at Assheburn on Wednesday, 80 August, to enquire of the premises.

Feb. 8. Whereas the king understanding that the monastery of Dunbrothy in

Westminster. Ireland was in a decayed state, by letters patent lately granted power to Ralph Meillere, Nicholas Deuros and others of the land of Ireland to supervise the monastery and order the temporalities, Nicholas, abbot of Buldewas, has made petition before him and the council in Parliament that inasmuch as the monastery with all its possessions has on this account been taken into the king's hands and by an inquisition made and returned into the chancery by the king's command it has been found that Hervey de Monte Morici, sometime marshal of Ireland, granted in frank almoin to God and St. Mary and the abbot and monks of Buldewas all lands, rents and possessions of that monastery, for his soul and the soul of Henry, sometime king of England, and for the souls of their ancestors and successors, and that the abbot of Buldewas afterwards, in 1185, founded a monastery, called Port St. Mary, Duinbrothy, and appointed an abbot and convent of monks there to celebrate divine service for the souls aforesaid, reserving to himself the superiority and visitation of the same, the king will commit the custody of the abbey to him so long as the same shall remain in his hands, and the king, because it seems to the council that ecclesiastics ought to have the custody of lands pertaining to spiritualities sooner than laymen, has committed the custody to the abbot as prayed. Dorset, of the time of such first pas- sage, with taking six sarplars of wool, not cocketed or customed, from those ports and that because in the said letters of pardon there is no express mention of the said six sarplars the barons have hitherto deferred to allow the same letters when exhibited before them, and praying that these may be made anew and the six sarplars specified in them ; the king, on surrender of the letters by the said Ralph, in consideration of the good service afore- said, has pardoned the said forfeiture and whatever else pertains to him because the said Ralph took the six sarplars not cocketed or customed.

Although the king by judgment of the court of King's Bench lately recovered his presentation to the church of Lanrihom, in the diocese of Exeter, against John Lercedeakne, by reason of the lands of Thomas Leroedealme being lately in his hands, and has presented to the same church Ralph de Poleye, yet, because William de la Pomereye, parson of the same church, has shewn before him evidence proving that the advow- son of the church, after the death of the same Thomas, was assigned in dower with other advowsons to Maud late his wife, and she, as true patroness, presented the same William, who was admitted to the same by the diocesan, and that the lands of the said Thomas were not at any past time taken into the king's hands, so that he could have no right of presentation, and the said Ralph, appearing in the chancery, has said nothing of effect against this, he has thought fit to revoke his said presentation and ratifies the estate of the said William as parson of that church on the presentation of Maud.

Pardon to John Aunsell of Totenham of his outlawry in the busting of London at the king's suit for non-appearance before him to satisfy him of the ransom due on account of a trespass against John de Parys, 'mercer,' whereof he was convicted before him by a jury ; on certificate by William de Thorpe, chief justice, that he has been taken on that account and imprisoned in the Marshalsea and has satisfied John de Parys of the damages adjudged to him in that behalf.

Feb. 16. Grant to Thomas Cok, seneschal of Gascony, for good service and Westminster, because he is retained to stay with the king for life and has undertaken

the rule of his said office of seneschal for one year from 20 June last, as well as for his better maintenance of the estate of banneret which for the king's honour and the better rule of the office he has taken, of 200 marks at the exchequer of England yearly, to wit 100 marks for him and his heirs and 100 marks for him for his life. Grant also that he shall have for life land of the value of 200/. yearly out of lands of rebels in the duchy yet being without the king*s hands, so soon as ever such lands shall come mto them by conquest. Appointment for life of John Marreys, king's yeoman, to. hold the ofiice as well of the alnage of canvas, linen web, naperv made as well in England as elsewere, ' wadynell,' * haydok,' * mendeps,' kerseys, serges of Louthe, Worstede, Norwich, Ireland and Gauston, and of all other serges and scarlets, and all kinds of cloths of London, York, Winchester, Bristol, Lincoln, Essex, Norfolk, Suffolk, Kent, Staunford, Beverley, St. Osyth, Devon and Cornwall, as also of all other cloths made in England, as well as of the seal ordained for the office of the alnage and all that pertains to the office, in the same manner as others have held the office of the grant of the king's progenitors. Also it is the king's will, and he charges that all such cloths for sale between merchant and merchant, which shall be of the right assize, shall be sealed before being exposed for sale, under the penalty hitherto accustomed.

Composition, dated 1241, Wednesday in Easter Week, between D. abbot of Thorney, and W. prior of Ely, to settle dissensions between them over the marsh of Whitlesh', granting for them and their successors that, from Thorn [ey] Cross as far as Eldemuster from the shore (hora) of the great river towards the alder wood called ' Aldegore,' there should remain to the abbot and his men of Stangrund and their successors 70 perches of the marsh of Witlesh', each perch of 24 feet, to hold from Easter to Michaelmas, within which term it should not be lawful for the prior to enter to feed his cattle or animals, or to mow or to carry anything away, but if the hay be carried by Michaelmas the prior and his successors and their men of Witlesh' and the abbot and his successors and their men of the same town shall have free ingress into the 70 perches to feed their cattle and animals, and at the head of the 70

perches towards the alder grove a djke shall be raised longitudin- ally at the common charge of the township of Witlesh*, beyond which dyke towards the alder grove the men of Stangrund shall have no common or easement, but that whole marsh shall remain to the abbot and his men of Witlesh*, and to the prior and his men of the same, and the dyke shall be raised so as to be no nuisance to any fishery of the abbot, and if there be any fishing in the dyke, two thirds thereof shall be to the abbot and one third to the prior. Composition between Robert, abbot of Thorneye, and the convent of that place, of the one part, and Roger, prior of Ely, and the convent of that place, of the other part, in the presence and with the consent of John, bishop of Ely, of long-standing controversies over the alder grove, marsh, pastures and waters, meadows, weirs and fisheries pertaining to the manor of Witleseie, to wit the marsh and all the herbage shall remain in common to the abbot and the prior and their men of Witleseie, saving the meadows from Easter to Michaelmas, unless perhaps the hay shall be carried before Michaelmas ; if however by negligence or otherwise the hay be there after Michaelmas, the pasture shall nevertheless be common to the abbot and the prior and their men. Touching the alder grove called * Aldegore,* it is thus provided, to wit that from Thorney Cross it shall be divided by a straight line eastward as far as Midfentre,* by view of lawful men, and the part of the grove and marsh towards Thorney shall remain to the abbot and convent in sequestration and property, and the part towards Witleseie shall be to the abbot, the prior and their men in common, and they shall take what shall be necessary in that part of the grove towards Witleseie, by view and assignment of the bailiffs of the abbot and prior, and they shall give or sell nothing of vert or old outside the territory of Witleseie without the licence of the abbot and prior. Furthermore touching the waters it is agreed that the whole fishery of the water of Must shall remain to the abbot and convent in property, but touching the fishery of Brodhe it is agreed that the wear called * Ninech ' with a moiety of the wear called Brugwere shall remain to the prior and convent in property, and the water between the said weir of Brugwere and Kingesdelf shall remain between them in common according to the respective portions of either party. But the water of Kingesdelf, as far as Medeswell shall remain to the abbot and convent. Any infraction of this composition shall be amended at the valuation of four good men, two of the one party and two of the other party, selected for this. convent of Thorneye, deforciants, of a third part of the marsh, which part begins at the head of the dyke dividing the marsh of Thomeye and Wysebech towards the south, passes thence to the alder wood called ' Estdelf,' thence beneath the wood to Binge- brigge, thence to Midfentre, called * Elde Thomeyweye,' and thence to the head of the dyke aforesaid, and contains 1,200 acres, by the great number, by the perch of 20 feet. The prior and convent acknowledged the other two parts to be the right of the abbot and convent and their church of Thomeye, and in return for this the abbot and convent acknowledged 400 acres of the marsh called ' Eldegore,' beginning at Delfdik and lying by the abbot's dyke towards the Cross and containing one league, 12 perches excepted, towards the west and thence extending from the demesne meadows of the abbot and his men of Stangrund in breadth towards the south, containing half a league and 2 perches, and thence to Delfdik, in length containing 1 league, 12 perches, and there in breadth half a league and 2 perches, together with 200 acres of marsh which the prior has within the said metes of his portion. And all the rest of the marsh shall be common to the abbot and the prior and their men of Wythleseye.

4. Composition between Hugh, sometime abbot of Bamsey, and the convent of that place, and Robert, then abbot of Thorney, and the convent of that place, touching the marsh between Eyngesdelf and Wetlesmare, whereof a perambulation has been made, which they promise to observe.

5. Composition between Hugh, bishop of Ely, of the one part and William, abbot of Thorney, of the other part, granting that the abbot shall have the view of frankpledge of their men in Wittleseie with all appurtenances of such view of frankpledge, saving to the bishop causes involving judgement of life and limb, for which his bailiff shall come if he will on days of the abbot's view at Wittleseie, which will be yearly, on Thursday in Easter week and on the morrow of the octave of Michaelmas and likewise at other times whenever there shall be any indicted of such felonies. The free tenants of the abbot in Wyttleseie shall not be prevented from doing at the bishop's hundred and the abbot's view of frankpledge as they have been wont to do in the past, and they shall have the same measures and weights as are used in the liberty of Ely, which the bishop's .bailiff shall deliver to the abbot's bailiffs without charge ; and for this agreement the abbot shall pay the bishop 2 marks yearly. And afterwards when I visited him in his sickness, he granted to the same church, in frank almoin, a moiety of the manor and prayed me much to so grant, and I have granted and grant it. March 16* Whereas the church of Reculvre, in the diocese of Canterbtiry, of the MrMtminskr patronage of the archbishop of that place, was of old appropriated to the

hospitals of Herbal doune and Northgate, and such appropriation in the time of John de Peccham, late archbishop, by authority of the apostolic see, was revoked, which church the archbishops have hitherto collated to secular clerks, and whereas for the revocation of the said appropriation they have been charged to the present time with the payment of 140^. and the parsons of the said church have been charged with the payment of 20/. yearly to the said hospitals ; the king, at the request of John, the present archbishop, has granted licence for the appropriation of the church and the chapels connected with it, on the decease or cession of the rector, to the archbishop* s table ; provided always that he and his successors and the prior and convent of Christ Church, Canterbury, in any vacancy of the see, be held to pay the said 160/. yearly to the hospitals and that the king and his heirs be in no wise held to pay the same in such vacancies. John de Croxford the younger of six messuages, 100 acres of land, the passage over the water of Sandford by Oxford and 20.^. of rent in Whitteneye, Sandford, Yiftele, Littlemore and Couele to three chaplains to celebrate service in Whitteneye church, and afterwards William de Edyngdon, bishop of Winchester, the said lands being not yet given in mortmain, acquired in fee twelve messuages, 100 acres of land, 6 acres of meadow, 4/. 8^. of rent and a rent of 1/^. of cummin and one capon, in Whitteneye, Churchecouele, Littelmore and Yiftele and the passage over the water of Saunford by Oxford, which are, as the king has truly been informed, the same lands for which the said Richard and John obtained their licence, although now, having been augmented on account of divers arrentations, approvements and buildings put in void plots in the meantime, they are specified by the number and quantity, wishing to carry out the original intention and making petition to the king that, whereas he has ordained to create a perpetual chantry of one priest warden and two other chaplains in the said church and endow it with the tenements aforesaid, he may have licence for this ; the king for a fine made by the bishop has granted licence for the alienation of the said messuages, lands, rents and passage to the warden and his successors for the sustenance of them and two chaplains to be found by them to celebrate divine service daily in the said church for the good estate of the king and the bishop, for their souls after they are dead, and for the souls of the king^s progenitors and heirs and of the father, mother, brothers, sisters and benefactors of the bishop.

advowsons of the deanery of the collegiate church of Tarn worth, and the prebends in that church, which are held in chief as is said, belonged, made certain compositions between themselves to present to the same by turns, and Joan, while she was single, presented to the deanery, and afterwards he, in her right, presented to the prebend of Wylmyndyncote, in that church, by virtue of such compositions, and whereas in the case of that prebend the king recovered his presentation for that turn because the compositions were made without his licence, the king will provide for the security of him and the heirs of Joan for the future, the king has pardoned their trespass in entering into the compositions aforesaid without licence and granted that the compositions shall remain of force. April 7. Whereas the late king by letters patent granted licence for the abbot

Westminster, an^ convent of Seleby to appropriate the church of Stanford, in the

diocese of Lincoln, of their advowson, the present king, because such licence was never put into execution and because the abbot and convent have surrendered for cancellation such letters patent, as well as two other letters patent wherein he is bound to them for 50L which they have released, also for a fine of 100 marks paid to him in the chamber, has granted licence for them to appropriate the church of Bray ton, in the diocese of York, likewise of their advowson. April 10. Protection with clause rogamiis, for three years, for brother Roger de Westminster. Co^hale and other proctors whom the prior, canons and brethren of the

priory of Breydeshale Park, co. Derby, are sending to divers parts of England to collect alms in churches and other places for relief of their estate, now depressed by the plunder of their priory and all that they had to live on by a sudden entrance of thieves and by the subsequent burning of the priory.

April 8. Exemplification at the request of John White of Tyllathfofhyn, burgess

Westminster, of Dundak, of the enrolment on the chancery rolls of a writing of quit- claim, with a memorandum made thereon, of Simon Fitz Richard, knight, to the said John of all right in the lands in Philpiston Nugent, Nyweton of Coly, Castelton of Dundalk, Ken, Verdonystdn and Colymon, which the said John held of his gift. ^f^'. ^?* Exemplification, at the request of John Cosyn, warden of the chapel of . ' -^ - St. Mary, Sibethorpe, of the tenors of records and processes before the justices of the Bench as follows :—

(1.) Pleas at Westminster in fifteen days of Michaelmas, 21 Edward III, Ro. 624, Nottingham to wit. John son of Ralph Chaumpenejs of Quappelade and Margaret, his wife, and Roger son of William de Flete, demand against the said warden the manor of Sibethorpe as the right of Margaret and Roger, by writ of right because Stephen Waleys, chief lord, &c. released to the king his court thereof. They say that one Ralph de Sancto Paulo, ancestor of Margaret and Roger, was seised of the manor in the time of King Richard and that from him the right therein descended to Dionisia, his daughter and heir, who afterwards married Alexander Bozon of Eirketon in Hoyland, knight, and had issue Ralph, to whom the inheritance descended, and as he died without heir of himself, the right passed to his brother, Hugh, and from him the same descended successively to Simon, his son, and to John son of the said Simon, who died without heir of himself, wherefore the right passed to his sisters Joan, Alice and the said Margaret, and from Joan, because she died without heir of herself, the right of her pourparty descended to her two sisters, and the right of Alice descended to Roger, the demandant, as her son and heir.

The warden acknowledges this, and says that the said John son of Simon died seised of the entire manor with all its appurtenances in Sibethorpe, Shelton and Knyveton, and after his death the same descended to the said Margaret then married to the said John son of Ralph, the said Alice and also to the said Joan, who afterwards married John the elder, son of Reginald de Aslacton, knight, that afterwards by a fine (produced) levied in the king's court at Nottingham, on Monday after Martinmas, in the third year of the present king, before William de Herle and his fellows, justices in eyre, between the same John son of Reginald, plaintiff, and John son of Ralph and Margaret, deforciants, the latter acknowledged one third part of the manor to be the right of the plaintiff, by virtue whereof John son of Reginald was seised of that third part of the manor ; as to the second third part of the manor he says that the same Alice by the name of Alice daughter of Simon de Kirketon in Hoyland, sometime wife of William son of Hugh de Flete, after the death of her husband, granted the same to the said John son of Reginald by a charter (produced), dated on Tuesday the vigil of St. Lucy, 8 Edward III ; and as to the remaining third part he says that the same John son of Reginald was seised of that in right of Joan his wife ; that afterwards by fine levied at York in fiSeen days of Hilary, 8 Edward III, before William de Herle and his fellows, justices of the Bench, between the same John and Joan, plaintiffs, and Hugh de Aslacton, chaplain, deforciant, of the same third part, the plaintiffs acknowledged the same to be the right of Hugh, and he regtanted it to them in tail, with successive

Judgment for the warden.

(2.) The like, on the octave of Hilary, 21 Edward III. Ro. 49, Nottingham to wit. William de Wodehous, demandant, and the same warden, tenant of the manor of Sibethorpe. The warden pleads that demandant released his right in the manor to the afore- said Thomas, founder of the chapel, who endowed the same there- with. Judgment for the warden.

(8.) The like, on the quinzaine of Martimas, 21 Edward III. Ro. 625, Nottingham to wit. The same warden is summoned to answer Thomas Freman of Sibethorpe and Emma, his wife, wherefore he took and unjustly detains their chattels. Thomas and Emma, by their attorney, William de Batheleye, complain that on Thursday after All Saints in this year at a place called * Thomashous Freman ' in Sibethorpe the warden took and detains a brazen pot and a pan.

The warden, by his attorney, William de Bitham, avouches the taking and justifies the same. He says that one John de Aslacton the elder, son of Reginald de Aslacton, knight, late lord of the manor of Sibethorpe, was seised of the tenement aforesaid as parcel of the manor and by indenture (produced), dated at Sibe- thorpe on Wednesday the Annunciation, 6 Edward III, enfeoffed the same Thomas and Emma of the same, to wit, a messuage in Sibethorpe lying in length from the highway towards the west as far as lands of the chantry of St. Mary, Sibethorpe, on the east, and in breadth between a messuage of Robert Adam and Geoffrey son of Richard de Kilvyngton, and six selions of arable land in the fields of Sibethorpe (specified in the indenture), they render- ing yearly 6s. and coming twice a year to the grantor's court at Sibethorpe, and if the rent should be in arrear at any time, the said lord bad power to distrain, and that the said manor after- wards became the property of the chapel as aforesaid. Judgment for the warden.

(4.] The like, on the quinzaine of Hilary, 20 Edward III. Ro. 164, Nottingham to wit. Robert son of WiUiam del Grene of Sibethorpe demandant, the same warden, tenant of an acre of meadow and 16Jr/. of rent, in Sibethorpe, by writ of right because Thomas de Sibethorpe, chief lord, etc. released to the king his court. Demandant says that one Goscelin son of Roger de Sibethorpe, ancestor of the demandant, was seised thereof in the time of King Richard, and from him the right therein descended through Thomas, his son and heir, Roger, son and heir of Thomas, Alice, daughter and heir of Roger, William, son and heir of Alice, to Robert, the demandant. The warden says that William, demand- ant's father, by deed granted the premises to the said Thomas de Sibethorpe, who endowed the chapel with the same at its foundation, and he produces a writing of quit-claim, witnessed by William son of Geoffrejr, Thomas, his brother, Thomas Peronel, Geoffrey Bithelane, William de Grantham, clerk, and others, wherein the premises are particularly set forth. The warden answers that the prior and convent long before the statute of mortmain was passed, on 10 January, 1267, by an indenture (produced) granted the tenements demanded to*Geoffrey le Clerk of Sibethorpe, under the name of Geoffrey Payn of Sibethorpe, to hold to him, his heirs and assigns at the rent of 20.s. 8^., that afterwards the prior by a writing, dated 20 December, 1802, released to the same Geoffrey and his heirs 6n. of the said rent, and that, after the death of Geoffrey, William his son and heir entered into the premises, and he granted the same to the said Thomas, the founder of the chapel, and the prior and convent of Thurgarton released to the same Thomas their right therein, by a writing dated on 20 October, 1884, and afterwards they formed part of the endowment of the chapel, after which the prior and convent released their right in the tenements and the rent aforesaid. March 15. Dn the petition of the king's serjeant at arms, Andrew de Guldeford, Wesiminster. shewing that, whereas it was lately ordained by Ralph de Ufford, then

justiciary of Ireland, and the king's council there, and publicly proclaimed, that whosoever should take Thomas Mactartan, an Irishman, giving him- self the name of king of Ovegh, a felon, enemy and rebel of the king, who had invaded the lands of him and some of his lieges of those parts, alive, should have 100/. or dead 40/. for his labour and charges therein, he afterwards took the said Thomas alive and brought him to his last punishment, as he deserved, and praying that the king will order for him payment of the 100/. or some assignment thereof ; the king, because Walter de Bermyngeham, now justiciary of Ireland, has testified before the council in Parliament that his petition contains the truth and that he has endured great damage and loss in the said service, has granted that he shall receive the farm of the city of Waterford, by the hands of the mayor and bailiffs, until he be satisfied in full of the 100/.

April 18. Pardon, for his good service in foreign parts, to Maurice Fitz Thomas, Westminster, earl of Kildare, of the king's suit for all homicides, felonies, robberies and trespasses in Ireland, whereof he is appealed, and of any consequent outlawries.

April 16. Whereas on 19 July, in his third year, the king with the counsel and Westminster, assent of the prelates and magnates in Parliament revoked a grant pre- viously made to Robert de Poleye, king's yeoman, of the assay of the alnage of cloths of worstedes in the city of Norwich and elsewhere in the county of Norfolk, which offioe Robert held by demise of John Pecok, who held the same by grant to him for life by Edward II, and caused letters patent made to the said Robert therein, which he then surrendered, to be cancelled ; he is now instantly entreated, as well on behalf of the workers of such cloths of worstede as of merchants of the same of the said county, by petition shewn in his last Parliament, to accept and ratify the said revocation and with the assent of the same Parliament he has thought fit by these presents to accept, ratify and confirm the same, revoking any grants or commissions made by him of the office of the assay of such cloths, granting that workers may work and merchants sell such cloths of worstedes without assay made thereof from henceforth.* By pet. of Pari.

Whereas Edward I granted licence for Walter de Langeton, then Westminster, bishop of Coventry and Lichfield, to build a wall round the close of the cathedral church of Lichfield and crenellate such wall, and the present king at the suit of Roger, now bishop of that place, and the dean and chapter there, shewing that, although after the enclosing of the same they have hitherto held the close at their will, so that no transit through the close of men, carts, wains or horses other than their own has been permitted, except with their licence, nevertheless certain of the town of Lichfield and the vicinage now claim to have a common transit through the close, although the said bishop, Walter, of his own free will for the public benefit caused a new way to be made there leading from Bakenstrete by the gate of the close, with bridges over the water there, sufficient for the transit of men, carts, wains and horses, and praying that he would con- firm the charter of Edward I, lately commanded John de Swynnerton, escheator in the county of Stafford, to make inquisition whether it wotdd be to the damage of anv if he were to grant the petition ; and whereas by such inquisition it has been found that it will not be to the damage of any or a nuisance to the town to do this : the king by these presents confirms the charter, so that only the bishop, the dean and chapter, and the ministers of them and the church shall have transit through the close.
